Рішення Опішнянської селищної ради про перейменування вулиці Василя Кричевського суперечить чинному законодавству. Фактично йдеться про перевищення повноважень зазначеної селищної ради.
9 червня Опішнянська селищна рада прийняла рішення про зміну назви вулиці Василя Кричевського, що була перейменована в рамках закону про декомунізацію. Місцеві народні обранці вирішили повернути цій вулиці стару назву — Партизанська. І хоч селищний голова рішення сесії ще не підписала (тобто воно є нечинним), сам факт уже набрав розголосу.
Нагадаємо, що голосували депутати вже після того, як голова Полтавської ОДА Валерій Головко підписав розпорядження про перейменування вулиць відповідно до вимог Закону України «Про засудження комуністичного та націонал-соціалістичного (нацистського) тоталітарних режимів в Україні і заборону пропаганди їх символіки».
Закон передбачав три етапи реалізації: до 21 листопада 2015 року рішення щодо перейменування ухвалювали органи місцевого самоврядування, після цього до 21 лютого 2016 року таке рішення міг прийняти голова місцевої ради. А з 21 лютого по 21 травня відповідне розпорядження зобов’язаний був підписати голова облдержадміністрації, що, власне, Валерій Головко і зробив 20 травня.
Щодо рішення Опішнянської селищної ради про перейменування вулиці Василя Кричевського, то воно перш за все суперечить чинному законодавству. А фактично йдеться про перевищення повноважень зазначеної селищної ради.
— Голосуючи за перейменування вулиці депутати селищної ради посилалися на те, що вони висловлюють думку громади Опішні, мають відповідні підписи мешканців вулиці, — прокоментувала начальник юридичного відділу Полтавської ОДА Тетяна Караваєва. — Проте згідно пункту 6 статті 7 Закону України «Про засудження комуністичного та націонал-соціалістичного (нацистського) тоталітарних режимів в Україні і заборону пропаганди їх символіки» були встановлені терміни виконання.
Юрист зазначає, що винні у порушенні термінів несуть відповідальність згідно закону.
— Місцевим радам було дано термін на перейменування, однак депутати нагодою не скористалася — і повноваження перейшли до голови облдержадміністрації. Він свої зобов’язання перед законом виконав. Рішення ж, прийняті всупереч передбаченим законом термінам, вважаються такими, що порушують закон, а отже є нікчемними. Нагадаю, що порушення закону передбачає персональну відповідальність винних осіб, в тому числі й кримінальну, — додає Тетяна Караваєва.
